These Terms and Conditions (“Terms”) govern your use of the website operated by Embodied With Nick (“Company,” “we,” “us,” or “our”) and any services, programs, coaching, digital products, or content provided.
By accessing this website or purchasing any service, you agree to be legally bound by these Terms. If you do not agree, you must not use this website or services.
2. Services Provided
Embodied With Nick provides online fitness and lifestyle coaching services, including but not limited to:
• Customized training programs
• Nutrition guidance
• Habit and performance coaching
• Digital resources and downloadable materials
• Email, messaging, or virtual support
• Video consultations and check-ins
All services are delivered remotely unless otherwise stated.
3. Not Medical Advice
All content and coaching provided by Embodied With Nick is for informational and educational purposes only. We are not medical professionals. Nothing provided through our website, programs, or communications should be interpreted as medical advice, diagnosis, or treatment. You agree to consult a physician before beginning any exercise or nutrition program.
4. Assumption of Risk
You understand that participation in exercise, physical training, and dietary changes involves inherent risks. By participating in our programs, you voluntarily assume all risks associated with physical activity and agree that Embodied With Nick shall not be liable for injuries, health complications, or damages arising from participation. Participation is at your own risk.
5. Eligibility
You must be at least 18 years of age to purchase services. By purchasing a program, you confirm that: you are legally capable of entering into a binding agreement; you have no medical condition that would prevent safe participation; and you accept full responsibility for your health and physical condition.
6. Payments & Billing
All prices are listed in Canadian Dollars (CAD) unless otherwise stated. Payment is required in full prior to the start of any coaching program unless otherwise agreed in writing. Failure to complete payment may result in suspension or termination of services. We reserve the right to modify pricing at any time without prior notice.
7. Refund Policy
Due to the customized and digital nature of our coaching programs, all sales are final. Upon purchase, clients receive immediate access to proprietary training materials, program structures, digital resources, and/or coaching services. As a result, refunds, chargebacks, cancellations, or partial reimbursements are not permitted once access has been granted. We encourage all prospective clients to ask questions and ensure the program is a good fit prior to purchase.
8. Intellectual Property
All content provided by Embodied With Nick, including workout programs, PDFs and guides, tracking sheets, branding and logos, website content, and coaching materials, is the intellectual property of Embodied With Nick.
You may not copy, reproduce, distribute, resell, share, or exploit any materials without written permission. Unauthorized distribution or reproduction may result in legal action.
9. Results Disclaimer
Individual results will vary. We do not guarantee specific physical, aesthetic, financial, or lifestyle outcomes. Success depends on individual effort, consistency, adherence, and personal factors beyond our control.
10. Limitation of Liability
To the fullest extent permitted by law, Embodied With Nick shall not be liable for indirect or consequential damages, loss of income or profits, personal injury claims arising from misuse of programs, or any damages exceeding the amount paid for services. Your use of this website and services is at your own risk.
11. Termination
We reserve the right to terminate services without refund if a client violates these Terms, engages in abusive, inappropriate, or disrespectful behavior, or fails to comply with program guidelines.
12. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts of Alberta, Canada.
